Tự ‘vẽ’ dự án, chiếm đoạt tiền tỷ của cộng tác viên môi giới bất động sản
Bị can Phạm Văn Đảng (SN 1991, ở phường Đức Giang, quận Long Biên) tự ‘vẽ’ ra các dự án bất động sản rồi lừa đảo, chiếm đoạt hàng chục người đã đóng tiền để được làm cộng tác viên môi giới.
Ngày 20/2, được biết, Viện KSND TP Hà Nội vừa hoàn tất cáo trạng truy tố bị can Phạm Văn Đảng (SN 1991, ở phường Đức Giang, quận Long Biên) về tội “Lừa đảo chiếm đoạt tài sản” theo quy định tại Khoản 4, Điều 174 Bộ luật Hình sự.
Cáo buộc xác định, năm 2016, Phạm Văn Đảng mua lại Công ty Viettek nhằm sử dụng công ty này để lừa đảo, chiếm đoạt tài sản.
Sau khi mua công ty, bị can nhờ người quen là bà Đặng Thị M. (SN 1946, trú tại thị xã Sơn Tây) đứng danh nghĩa Giám đốc, đại diện pháp luật.
Để điều hành Công ty dưới danh nghĩa bà M., bị can Đảng tự ký chữ ký đứng tên bà M. và sử dụng mẫu chữ ký này với các cơ quan chức năng. Anh ta cũng soạn giấy ủy quyền với nội dung “bà M. ủy quyền cho Phạm Văn Đảng điều hành mọi hoạt động của Công ty”.
Quá trình vận hành doanh nghiệp, Đảng lên mạng internet, vào trang web của một số doanh nghiệp bất động sản như: Tập đoàn FLC, Vingroup, tải hình ảnh về các dự án của các tập đoàn này vào máy tính. Đồng thời, thuê người chèn nội dung vào các hình ảnh thể hiện Công ty Viettek là chủ đầu tư hoặc liên kết đầu tư các dự án đó rồi in thành nhiều cuốn catalog.

Theo cơ quan điều tra, Phạm Văn Đảng giới thiệu Công ty Viettek là chủ đầu tư hoặc doanh nghiệp phân phối các dự án như Khu du lịch sinh thái Bình Yên với tổng mức đầu tư 100 tỷ đồng (dự án đang chờ thẩm tra); Khu Du lịch dịch vụ sinh thái Sơn Đông với tổng mức đầu tư 250 tỷ đồng (dự án đã giải phóng mặt bằng); Khu nhà ở thấp tầng Manhattan; Đầu tư, mua 20 lô biệt thự giá 300 tỷ đồng tại dự án FLC Hạ Long; Đầu tư, mua 50 lô biệt thự trị giá 450 tỷ đồng tại dự án Lideco; Đầu tư, mua 10 lô biệt thự nhà vườn, lô đất trị giá 200 tỷ đồng Dự án FLC Sầm Sơn và phân phối Dự án Eco Valley Resort….
Ngoài ra, bị can còn soạn thảo các văn bản với nội dung “tuyển cộng tác viên bán bất động sản” theo hình thức đa cấp. Mỗi cộng tác viên khi tham gia nhận được 1 mã ID với phí tham gia là 3,5 triệu đồng.
Để tạo niềm tin cho những người tham gia, sau khi nộp tiền, Công ty Viettek sẽ ký hợp đồng cộng tác viên môi giới bất động sản.
Tuy nhiên, đến cuối năm 2016, do thấy Đảng không có khả năng trả tiền hoa hồng cho những người nộp tiền như đã cam kết, nhiều bị hại tìm đến trụ sở công ty đòi tiền thì Đảng trốn tránh.
Theo Viện Kiểm sát, từ ngày 22/11/2016 – 17/1/2017, Phạm Văn Đảng đã nhận của 34 người tổng số tiền hơn 2 tỷ đồng, bị can đã sử dụng hết hơn 200 triệu đồng.
Khi mở rộng điều tra, cơ quan tố tụng xác định Đảng còn lừa đảo của bà Hà Thị M. số tiền 1 tỷ đồng với chiêu thức gian dối, dụ góp vốn vào dự dự án xây dựng Trung tâm chăm sóc sức khỏe cộng đồng Hà Nội. Ngay sau khi góp vốn, bà M. mới được Đảng trả trước 100 triệu đồng lãi suất.
