Ông Lê Hoàng Châu cho biết, tại cuộc họp trên, Thứ trưởng Bộ Tài chính Cao Anh Tuấn trình bày định hướng mới về xây dựng dự án Luật Thuế thu nhập cá nhân (thay thế) đã tiếp thu ý kiến của tất các chuyên gia và người dân với 4 nội dung chính sau.
Một, giữ nguyên cách thu thuế TNCN do chuyển nhượng bất động sản với thuế suất 2%/giá trị giao dịch hiện nay, trường hợp giá giao dịch thấp hơn giá sàn nhà đất.
Hai, chưa đề xuất áp dụng thuế suất 20%/thu nhập chịu thuế khi chuyển nhượng bất động sản.
Ba, chưa đề xuất áp dụng thu thuế TNCN theo thời gian nắm giữ bất động sản khi chuyển nhượng bất động sản như dự thảo Đề án Luật (trước đây), mà cần tiếp tục nghiên cứu có lộ trình khoảng 5 năm khi có đủ điều kiện thì mới xem xét đề xuất.
Bốn, tiếp tục nghiên cứu có thể nâng mức giảm trừ gia cảnh cá nhân lên trên 20 triệu đồng/người và người phụ thuộc lên trên 7 triệu đồng/người.
Ông Châu cho biết, Hiệp hội sẽ tiếp tục đeo bám và góp ý xác đáng để hoàn thiện các dự thảo Luật.
Trước đó, tại dự thảo Luật Thuế Thu nhập cá nhân (thay thế), Bộ Tài chính đề xuất thuế thu nhập cá nhân đối với thu nhập từ chuyển nhượng bất động sản của cá nhân cư trú được xác định bằng thu nhập tính thuế nhân với thuế suất 20% theo từng lần chuyển nhượng.
Thu nhập tính thuế từ chuyển nhượng bất động sản được xác định bằng giá bán trừ giá mua và các khoản chi phí hợp lý liên quan đến việc tạo ra thu nhập từ chuyển nhượng bất động sản.
Trường hợp không xác định giá mua và các chi phí liên quan đến việc chuyển nhượng bất động sản thì thuế thu nhập cá nhân được xác định bằng giá bán nhân với thuế suất.
Với bất động sản có thời gian nắm giữ dưới 2 năm thuế suất là 10%; đối với bất động sản có thời gian nắm giữ từ 2 năm đến dưới 5 năm thuế suất là 6%. Với bất động sản có thời gian nắm giữ từ 5 năm đến dưới 10 năm thuế suất là 4%. Với bất động sản có thời gian nắm giữ từ 10 năm trở lên và bất động sản có nguồn gốc từ nhận thừa kế thuế suất là 2%.
Với bất động sản có nguồn gốc từ nhận thừa kế, thuế suất chuyển nhượng vẫn như hiện hành, ở mức 2%, mà không tính theo thời gian nắm giữ. Bởi, Luật Dân sự quy định thừa kế là việc dịch chuyển tài sản của người đã chết cho người còn sống, khác với cho, tặng bất động sản.
Thời gian nắm giữ bất động sản tính từ khi cá nhân có quyền sở hữu, quyền sử dụng bất động sản từ ngày Luật Thuế Thu nhập cá nhân (thay thế) có hiệu lực đến thời điểm chuyển nhượng.
