Chủ tịch UBND TP HCM ra “tối hậu thư” cho doanh nghiệp nhà nước sử dụng đất sai mục đích
Doanh nghiệp nhà nước phải có đơn tự nguyện trả lại nhà, đất không còn nhu cầu sử dụng để TP HCM ra quyết định thu hồi.
Chủ tịch UBND TP HCM vừa có chỉ đạo, triển khai Chỉ thị 47/2024 của Thủ tướng Chính phủ về việc tăng cường quản lý, nâng cao hiệu quả sử dụng, xử lý nhà, đất tại doanh nghiệp nhà nước.
Theo đó, đối với các Tổng Công ty và Công ty trực thuộc UBND TP HCM, người đại diện theo pháp luật của doanh nghiệp nhà nước chịu trách nhiệm trước nhà nước đối với việc quản lý, sử dụng đất của doanh nghiệp mình.

Các Tổng Công ty và Công ty trực thuộc UBND TP HCM phải chủ động kiểm tra, rà soát lại việc sử dụng nhà, đất tại đơn vị, sử dụng đất theo đúng quy định; đảm bảo việc quản lý, sử dụng đất tiết kiệm, chống thất thoát, tham nhũng, tiêu cực, lãng phí; chấm dứt việc sử dụng nhà, đất vào mục đích cho thuê, cho mượn, bố trí làm nhà ở, liên doanh, liên kết… không đúng quy định.
Đối với nhà, đất không còn nhu cầu sử dụng thì doanh nghiệp có đơn tự nguyện trả lại đất gửi Sở Tài nguyên và Môi trường, để trình UBND TPHCM quyết định thu hồi đất.
Bên cạnh đó, các Tổng Công ty và Công ty trực thuộc UBND TP HCM rà soát, kiểm tra lại toàn bộ hồ sơ pháp lý nhà, đất đang quản lý, sử dụng.
Về phía cơ quan chức năng, Chủ tịch UBND TP HCM giao Sở Tài nguyên và Môi trường chủ động rà soát, hướng dẫn, hoàn thiện hồ sơ pháp lý về đất đai của các doanh nghiệp Nhà nước thuộc Trung ương và thuộc thành phố quản lý trên địa bàn theo đúng quy định pháp luật về đất đai đảm bảo thời gian quy định, tránh gây phiền hà, khó khăn cho doanh nghiệp.
Thường xuyên thanh tra, kiểm tra, phối hợp với UBND các quận, huyện, TP Thủ Đức và cơ quan thuế để phát hiện kịp thời, xử lý vi phạm hành chính về đất đai, đảm bảo việc sử dụng đất đúng quy định pháp luật.
Rà soát, tham mưu UBND TP thu hồi đất với doanh nghiệp nhà nước sử dụng sai mục đích, cho thuê, cho mượn trái phép, để bị lấn chiếm, chậm triển khai, không thực hiện nghĩa vụ tài chính hoặc không còn nhu cầu sử dụng.
Thanh tra Thành phố thường xuyên thực hiện việc thanh tra, kiểm tra, phát hiện kịp thời và xử lý nghiêm các hành vi vi phạm trong quản lý, sử dụng đất tại các doanh nghiệp nhà nước theo đúng quy định pháp luật, đảm bảo công khai, minh bạch, tránh thất thoát, lãng phí, tiêu cực.
Chi cục Thuế Khu vực II thường xuyên kiểm tra, rà soát việc xác định, thực hiện nghĩa vụ tài chính về đất đai của doanh nghiệp Nhà nước trên địa bàn Thành phố, đảm bảo thu đúng, thu đủ, tránh thất thu ngân sách nhà nước.
Trường hợp doanh nghiệp không thực hiện nghĩa vụ tài chính về đất đai thì có văn bản thông báo gửi Sở Tài nguyên và Môi trường thu hồi đất theo đúng quy định pháp luật đất đai.
UBND quận, huyện, TP Thủ Đức kiểm tra, chấn chỉnh việc sử dụng đất sai mục đích, cho thuê, cho mượn trái phép, lấn chiếm, bỏ hoang; xử phạt vi phạm hoặc báo cáo cấp trên nếu vượt thẩm quyền.
