Cách nào gỡ vướng cho hàng trăm dự án bất động sản tại TP HCM?
Dù đã có Nghị quyết của Quốc hội về cơ chế đặc thù nhưng hàng trăm dự án bất động sản (BĐS) tại TP HCM vẫn bị vướng mắc trong thực hiện thủ tục chấp thuận chủ trương đầu tư.
Hiệp hội Bất động sản TPHCM (HoREA) đã có kiến nghị gửi Thủ tướng Chính phủ, Bộ Kế hoạch Đầu tư, Bộ Xây dựng đề nghị sửa đổi điểm c khoản 7 Điều 31 Nghị định 31/2021/NĐ-CP và các quy định pháp luật có liên quan.
“Việc sửa đổi này rất quan trọng để thực hiện Nghị quyết 33/NQ-CP của Chính phủ và phù hợp với Nghị quyết số 98/2023/QH15 của Quốc hội về thí điểm một số cơ chế, chính sách đặc thù cho TP HCM”, ông Lê Hoàng Châu, Chủ tịch HoREA cho hay.
Theo ông Lê Hoàng Châu, trong quá trình xem xét, quyết định chấp thuận chủ trương đầu tư đồng thời chấp thuận nhà đầu tư đối với dự án nhà ở thương mại, dự án nhà ở xã hội thì TP HCM đã bị vướng các quy định tại điểm c khoản 7 Điều 31 Nghị định số 31/2021/NĐ-CP.
Vì vậy, UBND TP HCM đã có văn bản xin ý kiến Bộ Kế hoạch Đầu tư để được hướng dẫn tháo gỡ vướng mắc này. Tuy nhiên, theo HoREA, văn bản trả lời của Bộ Kế hoạch Đầu tư chưa đưa ra giải pháp để giải quyết vướng mắc về quy định nội dung thẩm định đánh giá sự phù hợp của dự án đầu tư với quy hoạch đô thị.
“Vướng mắc này cũng là vướng mắc chung của tất cả các địa phương, không chỉ riêng tại TP HCM, rất cần khẩn trương sửa đổi điểm c khoản 7 Điều 31 của Nghị định 31/2021/NĐ-CP để phù hợp với điểm b khoản 3 Điều 6 Nghị quyết 98/2023/QH15 của Quốc hội nhằm tháo gỡ vướng mắc trong thực hiện thủ tục chấp thuận chủ trương đầu tư cho tất cả các địa phương”, ông Châu khẳng định.
Việc sửa đổi điểm c khoản 7 Điều 31 Nghị định 31/2021/NĐ-CP và các quy định pháp luật có liên quan sẽ giúp hàng trăm dự án bất động sản ở TPHCM được gỡ vướng. |
Đồng thời, theo Chủ tịch HoREA, cần sửa đổi quy định liên quan tại Nghị định 30/2021/NĐ-CP và Nghị định 49/2021/NĐ-CP để bảo đảm tính đồng bộ, thống nhất trong thực hiện chỉ đạo của Chính phủ tại Nghị quyết 33/NQ-CP ngày 11/03/2023.
Theo ông Lê Hoàng Châu, Điểm c khoản 7 Điều 31 Nghị định số 31/2021/NĐ-CP chưa phù hợp với yêu cầu hướng dẫn thực hiện điểm a khoản 3 Điều 33 Luật Đầu tư 2020 về đánh giá sự phù hợp của dự án đầu tư với quy hoạch đô thị. Luật Đầu tư 2020 không quy định rõ sự phù hợp với quy hoạch đô thị ở cấp độ nào do có 3 cấp độ quy hoạch là quy hoạch chi tiết tỷ lệ 1/500, quy hoạch phân khu tỷ lệ 1/2000, quy hoạch chung.
HoREA nhận thấy, khi quy định chi tiết và hướng dẫn thực hiện điểm a khoản 3 Điều 33 Luật Đầu tư 2020 thì cần xác định rõ thủ tục chấp thuận chủ trương đầu tư đồng thời với chấp thuận nhà đầu tư chỉ là bước khởi đầu của chuỗi quy trình thủ tục đầu tư, xây dựng của các dự án bất động sản, nhà ở, đô thị. Bởi lẽ, sau khi đã được chấp thuận chủ trương đầu tư, nhà đầu tư còn phải thực hiện nhiều thủ tục tiếp theo, trong đó có thủ tục trình duyệt quy hoạch chi tiết tỷ lệ 1/500 tại Sở Xây dựng (hoặc Sở Quy hoạch Kiến trúc nếu dự án tại Hà Nội hoặc TPHCM) để đảm bảo sự phù hợp và tuân thủ các tiêu chuẩn của Quy chuẩn kỹ thuật quốc gia về quy hoạch xây dựng” theo quy định tại Thông tư số 03/2021/TT-BXD.
“Tại thời điểm này thì nhà đầu tư tự đề xuất quy hoạch chi tiết tỷ lệ 1/500, nhưng chưa trình cơ quan nhà nước có thẩm quyền phê duyệt vì chưa được chấp thuận chủ trương đầu tư đồng thời với chấp thuận nhà đầu tư. Lẽ ra, tại bước chấp thuận chủ trương đầu tư đồng thời với chấp thuận nhà đầu tư đối với dự án mà nhà đầu tư có quyền sử dụng đất, bao gồm cả dự án nhà ở xã hội thì điểm c khoản 7 Điều 31 Nghị định 31/2021/NĐ-CP chỉ nên yêu cầu dự án đầu tư phù hợp với quy hoạch phân khu hoặc quy hoạch chung là hợp lý nhất”, ông Châu nói.
